    ReportRocket is operated by ReportRocket Pty Ltd (ABN: Pending Registration), an Australian company. References to "ReportRocket", "we", "us", or "our" in these Terms refer to ReportRocket Pty Ltd.

    Welcome to ReportRocket. These Terms of Service ("Terms") govern your access to and use of the ReportRocket platform, including our website, applications, and services (collectively, the "Service").

    By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Service. These Terms constitute a legally binding agreement between you and ReportRocket Pty Ltd.

    1. Acceptance of Terms

    By creating an account or using ReportRocket, you confirm that:

    • You are at least 18 years of age
    • You have the authority to enter into these Terms
    • If using on behalf of a school or organisation, you have the authority to bind that entity to these Terms
    • You will use the Service in compliance with all applicable laws and regulations

    2. Description of Service

    ReportRocket is an AI-powered platform that assists Australian primary school teachers in generating student report comments. The Service includes:

    • AI-assisted generation of curriculum-aligned report comments
    • Class and student management tools
    • Collaborative review workflows for report quality assurance
    • School administration features for managing users and settings

    The Service is designed as a tool to assist teachers. All generated content should be reviewed and edited by qualified educators before use in official student reports.

    3. User Accounts and Registration

    To use certain features of the Service, you must create an account. You agree to:

    • Provide accurate, current, and complete registration information
    • Maintain the security of your account credentials
    • Promptly notify us of any unauthorised use of your account
    • Accept responsibility for all activities under your account

    We reserve the right to suspend or terminate accounts that violate these Terms or are inactive for extended periods.

    4. Acceptable Use Policy

    You agree NOT to use the Service to:

    • Violate any applicable laws, regulations, or third-party rights
    • Enter false, misleading, or fraudulent information
    • Attempt to gain unauthorised access to any part of the Service
    • Interfere with or disrupt the Service or servers
    • Use automated systems to access the Service without permission
    • Share account credentials with unauthorised persons
    • Use the Service for purposes other than educational report generation

    5. Intellectual Property

    Our Intellectual Property

    The Service, including its design, features, content, and underlying technology, is owned by ReportRocket and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express permission.

    Your Content

    You retain ownership of the student data and report content you create using the Service. By using the Service, you grant us a limited license to process and store your content solely to provide the Service to you. We do not claim ownership of your student data or generated reports.

    6. AI-Generated Content

    The Service uses artificial intelligence to generate report comments. You understand and agree that:

    • AI-generated content is a starting point and should be reviewed and edited by you
    • You are responsible for verifying the accuracy and appropriateness of all content
    • Generated content may require modification to suit individual student circumstances
    • We do not guarantee that AI-generated content will be error-free or perfectly suited to every situation
    • Final responsibility for report content rests with the teacher and school

    7. Subscription and Payments

    Subscription Plans

    The Service offers various subscription plans with different features and usage limits. Current pricing and plan details are available on our Pricing page.

    • Free tier: 10 personalised report comments total
    • Teacher Pro: 100 personalised report comments per semester
    • School licenses: Student-pool based usage, unlimited personalised comments within pool

    Billing

    • All licenses are purchased as one-time payments (not recurring subscriptions)
    • Individual licenses are available as semester or annual purchases
    • School licenses are available as semester or annual purchases based on tier selection
    • All fees are quoted in Australian Dollars (AUD) and include GST where applicable
    • Payment is processed securely through Stripe, a PCI-DSS Level 1 certified payment processor

    Free Trials

    School trials are available for eligible educational institutions with verified .edu.au or .gov.au email domains. Trial terms, including duration and student limits, are specified at the time of trial activation.

    Refunds

    As all purchases are one-time payments:

    • Refunds are not provided after purchase, except as required by Australian Consumer Law
    • For major service failures, you may be entitled to a refund under Australian Consumer Law (see Section 9)
    • If you believe you are entitled to a refund, please contact us

    8. Data and Privacy

    Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

    Key privacy commitments:

    • All data stored in Australia (AWS Sydney)
    • Compliance with Australian Privacy Principles (APPs)
    • Minimal student data collection (first name, pronouns, grade level only)
    • No sharing of student data for marketing purposes

    9. Australian Consumer Law

    Nothing in these Terms excludes, restricts, or modifies any rights you may have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010) or any other applicable consumer protection laws that cannot be excluded, restricted, or modified by agreement.

    Our services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled to cancel your subscription and receive a refund for any unused portion.

    10. Disclaimers and Limitations

    Service Availability

    We strive to provide reliable service but do not guarantee uninterrupted access. The Service may be temporarily unavailable for maintenance, updates, or due to circumstances beyond our control.

    Limitation of Liability

    To the maximum extent permitted by law:

    • We are not liable for any indirect, incidental, special, or consequential damages
    • Our total liability is limited to the amount you paid for the Service in the 12 months preceding the claim
    • We are not responsible for decisions made based on AI-generated content

    11. Termination

    We may suspend or terminate your access to the Service if:

    • You violate these Terms
    • Your subscription payment fails after reasonable attempts to resolve
    • We are required to do so by law or court order
    • We discontinue the Service (with reasonable notice)

    If We Terminate Your Account

    If we suspend or terminate your account:

    • Your right to use the Service ends immediately
    • You may request export of your data within 30 days
    • Data export requests will be processed within 14 business days
    • After 30 days, your data may be permanently deleted

    If You Delete Your Own Account

    • Personal accounts: Deletion is immediate and permanently removes all your data including classes, students, reports, and settings
    • School members: You must first leave your school (via School Admin settings), then you can delete your account. Your classes and reports will remain accessible to your school

    12. Indemnification

    You agree to indemnify and hold harmless ReportRocket Pty Ltd, its directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with:

    • Your use of the Service
    • Your violation of these Terms
    • Your violation of any rights of another party
    • Content you submit through the Service

    This indemnification obligation will survive termination of these Terms and your use of the Service.

    13. Dispute Resolution

    Informal Resolution

    Before initiating any formal dispute resolution, you agree to first contact us to attempt to resolve any dispute informally. We will endeavour to resolve complaints and disputes within 30 days.

    Formal Resolution

    If informal resolution is unsuccessful, disputes will be resolved through the courts of New South Wales, Australia. Both parties consent to the exclusive jurisdiction of these courts.

    14. Governing Law

    These Terms are governed by and construed in accordance with the laws of New South Wales, Australia. Any disputes arising from these Terms or your use of the Service will be subject to the exclusive jurisdiction of the courts of New South Wales, Australia.

    If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions will continue in full force and effect.

    The failure of ReportRocket to enforce any right or provision of these Terms will not constitute a waiver of such right or provision.

    15. Force Majeure

    ReportRocket shall not be liable for any failure or delay in performing its obligations under these Terms where such failure or delay results from circumstances beyond our reasonable control, including but not limited to: natural disasters, acts of government, war, terrorism, pandemic, power outages, internet service provider failures, or third-party service disruptions.

    16. Changes to Terms

    We may update these Terms from time to time. When we make changes:

    • Material changes will be notified by email at least 14 days before taking effect
    • Updated Terms will be posted on our website with a revised "Last updated" date
    • Your continued use of the Service after changes take effect constitutes acceptance
    • If you disagree with changes, you may cancel your subscription before they take effect

    We encourage you to periodically review these Terms to stay informed about your rights and obligations.

    17. Entire Agreement

    These Terms, together with our Privacy Policy, constitute the entire agreement between you and ReportRocket Pty Ltd regarding your use of the Service. These Terms supersede any prior agreements or understandings, whether written or oral, relating to your use of the Service.
